Brainwave is made in Sydney, Australia by Ryan Haste. By installing or using it you agree to what follows. If you do not, please do not use the app.

Please keep your own backups. Brainwave is beta software. It can lose data, and a beta version has done so before. Do not let it hold the only copy of anything you cannot afford to lose.

1. The beta

Access is by invitation, personal to you, and free. We may change the app, pause it, or end the beta and withdraw access at any time, without notice. Features can appear and disappear between versions.

2. Your content is yours

Everything you write, record and dictate stays yours. We claim no ownership of it and no licence over it. It is stored on your devices and in your own iCloud account, and we have no access to it. See the privacy page for what the app does send, which is technical health information about the app and never your content.

3. Using it sensibly

Do not use Brainwave to break the law, to record people where recording them would be unlawful where you are, or to try to attack, reverse engineer or interfere with the app or the services it depends on. Australian recording laws vary by state and are your responsibility.

4. No warranty

The app is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be reliable, uninterrupted, accurate, or fit for any particular purpose. Transcription is done by machine and will sometimes be wrong.

5. Liability

Nothing here excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded. Where a right cannot be excluded, our liability is limited, at our option, to supplying the app again or paying the cost of doing so. Subject to that, we are not liable for lost data, lost profits, or indirect or consequential loss arising from your use of the app.

6. Ending access

You can stop using Brainwave at any time by deleting it. Deleting the app leaves the copies of your notes that are in your own iCloud account, which you can remove yourself from iCloud settings. We may end your access to the beta at any time.

7. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state.

8. Changes to these terms

If these terms change, this page changes with them and the date at the top moves. Continuing to use the app after that means you accept the new version.
